Welcome to ForSWAGs and The Playbook for Life, platforms operated by ForSWAGs International (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, platforms, content, services, and applications provided through or in connection with https://forswags.com (collectively, the “Services”).

By accessing or using our Services, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please refrain from using the Services.

1. ELIGIBILITY

The use of ForSWAGs is intended for student-athletes, their families, coaches, recruiters, and affiliated professionals. Users under the age of 18 must have parent or legal guardian consent and supervision. You affirm that you are either over 18 or possess legal parental/guardian consent and are fully able to enter into this agreement.

2. SERVICES PROVIDED

ForSWAGs provides recruiting exposure, life coaching, academic consulting, skill development programs, and access to life-readiness content through The Playbook for Life. Services include:

  • Student-Athlete profile creation and evaluations
  • Recruiting video analysis and scout reports
  • Access to educational content (e.g., academic planning, life skills)
  • Regional/national promotion to college programs
  • Direct support and coaching from professionals in the field
  • Ongoing progress tracking and personal growth tools

We do not guarantee scholarships, offers, or outcomes. All services are intended as support and exposure tools to help athletes maximize opportunities.

3. USER ACCOUNTS

You may be required to create an account to access some features. You agree to provide truthful and accurate information. You are responsible for all activity under your account and must keep your login credentials secure.

Parents or guardians may create and manage accounts for their children. Multiple athletes may be linked to one parent account.

4. FEES AND PAYMENTS

Some Services are free (e.g., a basic profile, The Playbook For Life), while others are paid, including:

  • Tiered membership pricing depending on service level and plan
  • Optional renewals or add-ons

All fees are non-refundable unless otherwise stated in writing. Payment constitutes agreement to the related service terms.

5. USER CONDUCT

You agree not to:

  • Use our platform for unlawful, harassing, or fraudulent activities
  • Upload false academic, athletic, or personal information
  • Attempt to bypass security measures or gain unauthorized access
  • Use the platform to impersonate or misrepresent your affiliation

We reserve the right to terminate or suspend accounts for violations.

6. INTELLECTUAL PROPERTY

All content, branding, design, curriculum (including The Playbook for Life), and materials are the exclusive property of ForSWAGs, LLC. You may not copy, modify, distribute, or exploit any part of the Services without written permission. Violations will be subject to legal action to the fullest extent of the law.

7. DISCLAIMERS

The Services are provided “as is.” We do not make warranties regarding:

  • Guaranteed recruitment outcomes
  • Platform uptime or uninterrupted access
  • Accuracy of third-party information (e.g., college databases)

We are not responsible for any personal decisions, scholarships lost, or athletic opportunities missed.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ForSWAGs and its officers, staff, contractors, and partners are not liable for any indirect, incidental, or consequential damages resulting from your use of our Services.

9. TERMINATION

You may terminate your account at any time. We reserve the right to suspend or terminate accounts for misconduct, failure to pay, or breach of these Terms.

10. MODIFICATIONS

We may modify these Terms at any time. Notice of material changes will be posted on the website. Continued use after changes constitutes acceptance.

11. PRIVACY

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use your data. You consent to these practices by using the platform.

12. GOVERNING LAW

These Terms shall be governed by the laws of the State of South Carolina. Any disputes shall be resolved through binding arbitration or small claims court within that jurisdiction.
